Terms of Service

These terms are the agreement between you and Desmond Thomas for the use of FleetTend. By creating an account you accept them. If you are agreeing on behalf of a business, you confirm you are authorized to do so.
What the service is
FleetTendis a maintenance management tool for equipment fleets: equipment records, preventive maintenance schedules, work orders, parts inventory, manual links, and service history. It is a record-keeping and scheduling aid. It is not a safety system, a regulatory compliance system, or a substitute for a qualified technician's judgment.
Your account
You are responsible for keeping your password private and for what happens under your account. Tell us promptly if you believe someone else has access. One person's account administers one workspace; do not share a single login across a crew if you need to know who did what.
Acceptable use
Do not use FleetTendto break the law, to store data you have no right to hold, to attempt to reach another organization's records, to probe or overload the service, or to resell access. We may suspend an account that does these things.
Your data stays yours
You keep all rights to the records you enter. You grant us only the permission needed to host, back up, and display that data so the service can function. You can request a copy of your data or ask us to delete it at any time — see the Privacy Policy.
Fees
Any price, trial length, or free allowance in effect is stated on our website at the time you sign up. If we introduce or change fees for an account that already exists, we will tell you before they apply and you may close the account instead of paying.
Availability
We aim to keep FleetTend running and to warn you about planned downtime, but we do not promise uninterrupted service. Features may change as the product develops. If we ever discontinue the service, we will give you reasonable notice and a way to request a copy of your data.
No warranty
FleetTendis provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, that maintenance reminders will always be delivered on time, or that the records it displays are complete or accurate — that depends on what is entered into it.
Limitation of liability
To the fullest extent the law allows, Desmond Thomas is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, equipment damage, downtime, or missed maintenance, arising out of your use of FleetTend. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
Some jurisdictions do not allow some of these exclusions, in which case they apply to you only to the extent permitted.
Ending the agreement
You can stop using FleetTend and ask us to close your account at any time. We may suspend or close an account that breaches these terms, or that we must close to comply with the law.
Changes to these terms
We may update these terms. The date above will change and, for material changes, we will notify account holders. Continuing to use the service after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules.
