Terms of Service

Effective August 28, 2026. These Terms of Service (“Terms”) govern your access to and use of the FleetTend website, application, and related maintenance-management tools (collectively, the “Service”). The Service is operated by VibeAdapting LLC, an Ohio limited liability company, doing business as FleetTend. In these Terms, “FleetTend”, “we”, “us”, and “our” refer to VibeAdapting LLC.
By creating an account or using the Service, you agree to these Terms. If you use the Service for a company or other organization, you confirm that you are authorized to accept these Terms for that organization.
1. Description of the Service
FleetTend is a cloud-based maintenance-management platform for equipment fleets and small shop teams. Current tools include equipment and meter records, preventive-maintenance schedules and completion history, multi-task work orders, parts inventory, team access, manual links and searchable manual text, QR labels, and related service history.
We may add, change, or remove features as the Service develops. We may also temporarily limit access when reasonably necessary for maintenance, security, legal compliance, or to protect the Service and its users. We will provide reasonable notice when practical.
2. Accounts and workspaces
You must be at least 18 years old, or the age of legal majority where you live, to create an account. You agree to provide accurate information and keep it current. You are responsible for protecting your password and for activity performed through your account. Contact us promptly if you believe an account has been accessed without permission.
Each workspace has an owner and may have managers and technicians with different access levels. Each person should use their own login. If you invite someone into a workspace, you are responsible for managing that person's access and may deactivate it when appropriate. Workspace owners and managers are responsible for deciding who may view or change their organization's records.
3. Early access and future fees
FleetTend is free while in early access. There is currently no paid subscription, automatic renewal, or billing cancellation process. Any future prices, plan limits, trial terms, renewal terms, and refund rules will be disclosed before they apply. If we introduce a fee for an existing account, we will provide advance notice and you may stop using the Service instead of accepting the paid plan.
4. Your data and manuals
You retain your rights to the equipment records, meter readings, work orders, maintenance history, parts information, notes, and other content you enter into the Service (“User Data”). You give us a non-exclusive license to host, back up, process, transmit, and display User Data only as reasonably needed to provide, protect, support, and improve the Service.
Manual files remain hosted by the source you link to; FleetTend does not store the original PDF. When you choose to index a supported manual, the Service may store extracted text and page metadata so authorized members of your workspace can search it. You are responsible for linking or indexing only material that you are authorized to use.
You may ask us for a copy of your User Data or request deletion of your workspace. Some residual copies may remain in provider backups for a limited period before rotating out, as explained in the Privacy Policy.
5. Acceptable use
You agree not to:
- break the law or use the Service to create deceptive safety or maintenance records;
- upload malicious code, disrupt the Service, or bypass usage or security controls;
- access or attempt to access another organization's accounts or records;
- store or index content you do not have the right to use;
- resell, sublicense, or redistribute access without our written permission; or
- reverse engineer or attempt to discover non-public source code, except where applicable law expressly permits it.
6. FleetTend intellectual property
The FleetTend name, logos, original software, interface, documentation, and brand assets are owned by VibeAdapting LLC or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for your organization. They do not transfer ownership of FleetTend intellectual property to you.
7. Third-party services and links
The Service relies on third-party hosting, authentication, email, security, analytics, weather, and other providers. It may also open manufacturer manuals or other websites that you or another workspace member links. We do not control third-party content, availability, or policies, and your use of those services may be governed by their own terms.
8. Safety and warranty disclaimer
FleetTend is a record-keeping and scheduling aid. It does not replace physical inspections, manufacturer instructions, qualified technician judgment, certified mechanic evaluations, or required safety and regulatory checks. You remain responsible for the accuracy of your records and for the condition, safe operation, and legal compliance of your equipment.
The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted or error-free access, or that reminders and records will always be complete, accurate, or delivered on time.
9. Limitation of liability
To the fullest extent permitted by law, FleetTend is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, equipment damage, operational downtime, or missed maintenance arising from or related to the Service. Our total liability for a claim related to the Service will not exceed the greater of the amount you paid us during the twelve months before the event giving rise to the claim or one hundred US dollars.
Some jurisdictions do not allow certain limitations or exclusions, so some of this section may not apply to you.
10. Suspension and termination
You may stop using the Service and ask us to close your account at any time. A workspace owner or manager may deactivate a member's access. We may suspend or terminate access for a material breach of these Terms, suspected unlawful or harmful activity, a security risk, or when required by law. When practical, we will provide notice and a reasonable opportunity to request a copy of User Data before permanent deletion.
11. Privacy and security
Our Privacy Policy explains how we collect, use, retain, and protect information. We use technical and organizational safeguards intended to protect User Data, including encrypted network connections and organization-level database access controls. No online service can guarantee absolute security.
12. Changes to these Terms
We may update these Terms as the Service changes. We will update the date above and notify account holders of material changes. When reasonably practical, we will provide notice before a material change takes effect. Continued use after the effective date of revised Terms means you accept them.
13. Governing law and disputes
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Before starting formal proceedings, you and FleetTend agree to try in good faith to resolve the dispute informally by contacting the other party.
